This application for anticipatory bail arises out of Telhara P.S. Case N0. 57 of 2019, disclosing offences under Sections 304B,201/34 of the Indian Penal Code. The petitioner is mother-in-law of the deceased. Learned counsel for the petitioner has referred to the First Information Report to submit that there is general and omnibus allegation against all family members of the husband of deceased of having been made demand of dowry. He submits that there is no specific allegation against the petitioner of having ever made any demand of dowry.
Considering the facts and circumstances, this application is allowed.
Let the petitioner above named in the event of her
Patna High Court CR. MISC. No.56396 of 2019(2) dt.05-09-2019 2/2 arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate First Class, Hilsa, Nalanda in Telhara P.S. Case No. 57 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present herself before the Police/Court, as the case may be, as and when required and in the event of failure on her part to appear before the Court on two consecutive occasions, her bail bonds shall be liable to be cancelled.
