2. The petitioner seeks bail in a case registered for the offence punishable under Sections 148, 341, 323, 307, 354(A) , 34 of the Indian Penal Code.
3. Petitioner is said to have assaulted the father of the informant with rod and lathi causing injury at his head.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case due to land dispute. He submits that there is case and counter case between the parties. He submits that the petitioner is old aged person and also suffering from several old aged diseases. He submits that similarly situated co-accused has already been granted bail by this Court vide order dated
Patna High Court CR. MISC. No.64668 of 2024(3) dt.18-10-2024 2/2 14.08.2024 passed in Cr. Misc. No. 57971 of 2024. He further submits that petitioner has no criminal antecedent as stated in para-3 of the bail application and he is languishing in judicial custody since 26.06.2024.
5. Learned APP for the State opposes the prayer for bail.
6. Considering the facts and circumstances of the case, let the above named petitioner, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Kumarkhand P.S. Case No. 55 of 2022.
