JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 03-02-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Majorganj P.S. Case No. 21 of 2016 registered under Sections 395 and 397 of the Indian Penal Code and Section 3/4 of the Explosive Substance Act and Section 27 of the Arms Act. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. but in course of investigation, petitioner and one Rabindra Safi were apprehended by the police. Thereafter, police got recorded their confessional statement as detailed in paragraph 49 and 50 of the case diary, showing their involvement in the present case except that there is nothing against the petitioner. It is further submitted that petitioner is in custody

Patna High Court Cr.Misc. No.2389 of 2017 (2) dt.03-02-2017 since 31.05.2016. It is further submitted that similarly situated coaccused, Ravindra Safi, has already been granted privilege of bail by this Court vide order dated 14.12.2016 passed in Criminal Misc. No. 52008 of 2016.

Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi, in connection with Majorganj P.S. Case No. 21 of 2016. Out of two sureties, one surety must be the close relative of the petitioner. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
