This application for anticipatory bail arises out of Kasma P.S. Case No. 27 of 2019, disclosing the offence under Sections 342, 365, 511/34 of the Indian Penal Code. It is alleged in the FIR that petitioner had taken the informant to the house of one Nisar Ahmad and had locked her in a room in the house of Nisar Ahmad.
Learned counsel appearing on behalf of the petitioner has submitted that earlier also an FIR was registered alleging kidnapping of the informant giving, rise to Kasma P.S. Case No. 22 of 2019 in which petitioner's son was made an accused. It has been argued that co-accused Nisar Ahmad has been granted the privilege of regular bail by this Court.
Patna High Court CR. MISC. No.56724 of 2019(2) dt.06-09-2019 2/2 Considering the facts and circumstances, this application is allowed. Let the petitioner, above-named, in the event of his arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand), with two sureties of the like amount, each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad in Kasma P.S. Case No. 27 of 2019, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present herself before the Police/ Court, as the case may be, as and when required and in the event of failure on her part to appear before the court on two consecutive occasions, her bail bonds shall be liable to be cancelled.
