ANJANA MISHRA ORAL ORDER 19-09-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is in custody since 14.05.2019 in connection with Patna G.R.P. P.S. Case No. 263/2019 registered for the offence punishable under Sections 379/411/414 of the Indian Penal Code.

Learned counsel for the petitioner submits that though the alleged recoveries have been saddled on his shoulder, the petitioner had found the mobile lying on the railway platform and for the said reason on search being made, the same was recovered from his possession. The petitioner has not stolen the same and it was only a case of lost and found. Learned counsel for the petitioner further submits that so far as his antecedents is concerned, he is on bail in the said cases and he

Patna High Court CR. MISC. No.56055 of 2019(2) dt.19-09-2019 2/3 undertakes not to abscond or tamper with any evidence and shall appear before the Railway Magistrate as and when required by him. It is further submitted that the deponent of the present bail application shall be his bailor and or any blood relative shall be his bailor.

Considering the aforementioned facts and circumstances, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Railway Magistrate, Patna, in connection with Patna G.R.P. P.S. Case No. 263/2019, subject to the following conditions:-

(1) One of the bailors will be deponent of the petitioner.

(2) The petitioner shall not indulge himself in any similar offence till conclusion of the trial.

(3) The petitioner shall remain physically present in court on each and every date during trial and in the event of failure on two consecutive dates without sufficient reasons, his bail bonds shall be liable to be cancelled by the learned court concerned.

(4) The petitioner shall co-operate with the
