1. Heard the parties.
2. The petitioner apprehends his arrest in connection with Jamui P.S. Case No. 386 of 2024 dated 22.06.2024 registered under Sections 302, 324, 120-B, 34 of the I.P.C.
3. As per the prosecution case on 22.06.2022 at about 9:00 A.M. in the morning the daughters of the informant namely, Sonal Sinha (deceased) and Priya Sinha went to temple for performing "puja" and while they were returning after "puja", in the meanwhile, Kundan Ram assaulted the informant's daughter Sonal Sinha with knife and when Priya Sinha intervened to save her sister, he also gave knife blow to her, due to which she sustained injury in her finger.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case merely because he
Patna High Court CR. MISC. No.64055 of 2024(2) dt.05-10-2024 2/3 happens to be the uncle of the co-accused / Kundan Ram. The petitioner is residing separately from the family of Kundan Ram for about more than thirty years. The CCTV footage of the occurrence shows that Kundan Ram was inflicting blow upon the deceased. He further submits that the marriage of the coaccused Kundan Ram was performed with the deceased in the year 2022 and out of their wedlock one child had born. The deceased had filed a divorce case against the co-accused / Kundan Ram due to which he killed his wife. The petitioner has not played any role in the murder of the informant's daughter inasmuch no material has come against the petitioner to connect him with the present offence.

Regard being had to the submission made by the parties, taking into consideration the nature of allegation and the fact that there is specific allegation of assault upon the co-accused Kundan Ram, who happens to be the husband of the deceased, I am inclined to grant anticipatory bail to the petitioner.
6. Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of
