The petitioner apprehends his arrest in G.B.Nagar P.S. Case No.77 of 2019 registered under Sections 272, 273 and 308 of the Indian Penal Code and Sections 30(a), 34, 36, 38 and 41(1) of Bihar Prohibition and Excise Act.

The police of G.B. Nagar got information that Harkesh Pasi, Sunil Pasi, Raju Pasi, Rakesh Pasi were selling liquor in their shop. Surendra Prasad, former Mukhiya of Kartarpur, his son, Sonu Kumar had also kept liquor in their house and they were selling the same. Vinod Choudhary had bought liquor from Indal Bin and Ranglal Bind(petitioner) and kept near the PACS godown. Raid was conducted and liquor was recovered from different places. Vinod Choudhary was also apprehended.

The learned counsel for the petitioner submits that house of the petitioner was not raided and nothing has been recovered from the possession of the petitioner. Simply Vinod Choudhary disclosed that he bought the liquor from the

Patna High Court CR. MISC. No.58007 of 2019(2) dt.18-09-2019 2/2 petitioner and Indal Bin. Name of the petitioner figured on that disclosure.

Taking into consideration the facts aforesaid and the fact that nothing has been recovered from the possession of the petitioner and the name of the petitioner figured in the case only on the basis of disclosure made by Vinod Choudhary that he purchased liquor from petitioner and Indal Bin and petitioner has got no criminal antecedent, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge-cum-Special Judge, Excise, Siwan in connection with G.B.Nagar P.S. Case No.77 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
