It appears that the learned Sessions Judge has not entertained the prayer for anticipatory bail of the petitioners for the reason that the petitioners appeared before the police on notice under Section 41(A) of the Cr.P.C. and the petitioners were released on personal bond.
Submission is that charge sheet has already been submitted in this case, hence, the petitioners might be sent to jail by the learned Court-below.
The Court-below shall consider the fact that the petitioners have not misused the privilege of bail granted by the
Patna High Court Cr.Misc. No.2983 of 2017 (3) dt.23-02-2017 2/2 police while disposing of his prayer for bail. With the aforesaid observation, this application stands disposed of.
