1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. This application, for grant of anticipatory bail, arises out of Saharsa Sadar Police Station Case No. 133 of 2023, dated 26.02.2023, disclosing offences punishable under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.
3. 75 litres of wiscof cough syrup, having codeine, has been recovered from the room of the petitioner.
4. Learned Counsel for the petitioner submits that the petitioner has falsely been implicated in this case. The petitioner is not the owner of the room, in question, inasmuch as he is living in the concerned room as a
Patna High Court CR. MISC. No.62176 of 2023(3) dt.29-02-2024 2/2 tenant. At the time of raid, the petitioner was not present in that room. The petitioner is an Engineer and his staff would have kept the illicit cough syrup in the room, in question.
5. Regards being had to the submissions advanced on behalf of the parties and taking into consideration the fact that from perusal of the seizure list, prima facie case is made out against the petitioner, I am not inclined to grant the petitioner privilege of anticipatory bail.
