Petitioner apprehends his arrest in Complaint Case No.818C of 2018, for the offences allegedly committed by the petitioner under Sections 498A, 323, 324 and 406 of the Indian Penal Code and 3 and 4 of the Dowry Prohibition Act. The complainant alleged that the petitioner after marriage subjected his wife, the complainant, to different sorts of torture due to non-fulfillment of additional demand of dowry. The petitioner was demanding Rs.7 lacs but father of the complainant refused to pay.

Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.55751 of 2019(2) dt.06-09-2019 2/2 complaint petition was filed on 23.08.2018. Prior to institution of the present case, the petitioner filed divorce case against the complainant. The complainant herself gave undertaking that she would not make any hue and cry in her matrimonial house but she continued her unruly behaviour with her in laws. Taking into consideration the facts that prior to institution of the present complaint case, the petitioner filed divorce case against the complainant for dissolution of marriage on the ground of her cruel behaviour and adultery, let petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Munger in connection with Complaint Case No.818C of 2018, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
