The petitioner apprehends his arrest in connection with Palasi P.S. Case No. 105 of 2016 registered under Sections 363, 366A/34 pending in the court of learned Additional Chief Judicial Magistrate-3rd, Araria.
The accusation is that six persons including the petitioner kidnapped the daughter of the informant.
The victim girl in her statement, recorded under Section 164 Cr.P.C., has supported the prosecution case. Having considered the facts and the circumstances of the case and the nature of allegation, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer of the
Patna High Court Cr.Misc. No.4585 of 2017 (2) dt.17-03-2017 petitioner for grant of anticipatory bail stands rejected. However, the petitioner is directed to surrender before the trial court within four weeks from today and pray for regular bail, which shall be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
