Learned counsel for the petitioner fairly submitted that this writ petition has been filed under wrong advice, as the statutory appeal is provided under the act against the order of punishment. Therefore, he may be permitted to withdraw this writ petition with leave, so that the petitioner may present the appeal with a petition to condone the delay and after disposal of appeal the petitioner may file the writ petition.
