The petitioner is accused in connection with Kishanganj P.S. Case No. 453 of 2016, registered under Sections 370 and 370(A)/34 of the Indian Penal Code and Section 5 of the Human Trafficking Prevention Rule, 2008.
The accusation is of carrying of nine children by Manirul and Ziabul Haque boarding on Magic vehicle, which was driven by this petitioner.
Learned counsel for the petitioner submits that it would appear from the F.I.R. that petitioner is simply driver of Magic vehicle and he has no concern with nine children recovered from the vehicle as they have been boarded by co-accused,
Patna High Court Cr.Misc. No.3936 of 2017 (2) dt.23-02-2017 Manirul and Ziabul Haque. It is further submitted that petitioner has no criminal antecedent and is in custody since 27.09.2016. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Kishanganj, in connection with Kishanganj P.S. Case No. 453 of 2016. Out of two sureties, one surety must be the close relative of the petitioner. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
