The petitioners seek bail in a case instituted under Sections 304(B) and 120(B)/34 of the Indian Penal Code. The prosecution story, in brief, is that the daughter of the younger son of the informant was married with one Manohar Rai. After marriage, a demand of motorcycle along with Rs. 50,000/- was started and for the same she was usually assaulted by her husband. On 10.08.2016, an altercation took place between the husband and wife. It is also alleged that all the accused persons killed his cousin by assaulting her.

It has been submitted on behalf of the petitioners that

Patna High Court Cr.Misc. No.1062 of 2017 (2) dt.28-02-2017 2/2 the petitioners are in custody since 12.08.2016. The charge sheet has been submitted in the present case. The petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioner no.1 is mother-in-law of the deceased and the petitioner nos.2 and 3 are Devar of the deceased. They are separate in mess and property from the husband of the deceased. The husband of the deceased is in custody.

On behalf of the state, it has been submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Katihar in connection with Azamnagar P.S. Case No. 222 of 2016. (Sudhir Singh, J) Amit/- U T
