ANJANA MISHRA ORAL ORDER 04-09-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 20.07.2019 in connection with Sarairanjan P.S. Case No.110 of 2019 registered for the offence under Sections 272, 273 of the I.P.C. and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that the alleged recoveries of foreign liquor have been made from three cars, which do not belong to the petitioner. The petitioner is the shopkeeper of poultry farm. It is further submitted that nothing has been recovered from the conscious possession of the petitioner.

Considering the aforementioned facts and

No.55702 of 2019(2) dt.04-09-2019 2/2 circumstances and that the petitioner has no criminal antecedents, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge 2nd Cum Special Judge, Excise, Samastipur, in connection with Sarairanjan P.S. Case No.110 of 2019.
