The petitioner seeks bail in connection with Riga P.S. Case No.139 of 2016/G.R. No.2040 of 2016 registered under Sections 399 and 402 of the Indian Penal Code besides Sections 25(1-b)a, 26 and 35 of the Arms Act and Sections 3/4 of the Explosive Substance Act.
The accusation is that seven persons, named in the F.I.R., including the petitioner, were apprehended by the police in suspicious condition and, on search, the petitioner was found in possession of two live cartridges.
Learned counsel appearing on behalf of the petitioner submits that the petitioner having no criminal antecedent is in
Patna High Court Cr.Misc. No.2113 of 2017 (2) dt.23-01-2017 2/2 custody since 05.07.2016.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-III, Sitamarhi, in connection with Riga P.S.
