2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 302, 201, 120B of the Indian Penal Code and Sections 25(1-b)a, 26/27 of Arms Act.
3. As per prosecution case, it is alleged that the deceased Sudha Shree was committed murder by shot fire by the accused persons. Allegation against the petitioner that she was in love affair with deceased husband.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. No one is eye witnesses and no any direct evidence has come against the petitioner. She had
Patna High Court CR. MISC. No.61707 of 2023(3) dt.29-11-2023 2/2 only love affair with the deceased husband and on the basis of suspicion, her name was sprang up in the case. She has got no criminal antecedent as stated in para-3 of the bail petition and she is languishing in judicial custody since 31.5.2023.. Moreover, co-accused Saurav Kumar was already enlarged on bail granted by a co-ordinate Bench of this Court vide order dt. 6.10.2023 passed in Cr. Misc. 63109 of 2023.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Kajra P.S. Case No. 73 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M. Lakhisarai.
