The petitioner apprehends his arrest in a case under Sections 302, 380/34 of the Indian Penal Code. The petitioner is not named in the F.I.R. The informant alleged that some unknown thieves committed murder of his aunt in course of committing theft, but after the occurrence, the son of the deceased made allegation that Sunil Ram was threatening his mother and, prior to the occurrence, Sunil Ram was seen with Ranjit Pandey and Anand Pandey (the petitioner). Save and except suspicion, there is no material to show the involvement of the petitioner.

Learned A.P.P. also did not dispute the aforesaid fact. Considering the facts aforesaid, the above named

Patna High Court Cr.Misc. No.40793 of 2015 (3) dt.01-12-2015 2/2 petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali in Bhagwanpur P.S.
