Petitioner is in custody since 01.02.2016 in connection with Piri Bazar P.S. Case No. 04 of 2016 registered under Sections 147, 148, 149, 332, 333, 353, 307 and 302 of the Indian Penal Code and Section 27 of the Arms Act including Sections 16, 18, 19, 20, 23 of the U.P.Act.
Learned counsel for the petitioner has submitted that there is general and omnibus allegation against the petitioner and no specific over act is attributed to him. In fact, on account of a complaint case No. 130 of 2016 lodged by the petitioner, in which the petitioner sustained fire arm injury by the informant, against the informant and others, the petitioner, who is of clean antecedent, has falsely been made accused in this case.
Patna High Court Cr.Misc.
