2. Petitioner apprehends arrest in case registered for the offences punishable under Sections Sections 126, 115(2), 109, 103, 3(5) of the Bharatiya Nyaya Sanhita.

3. As per F.I.R., on account of property dispute, all the named accused persons, including this petitioner, brutally assaulted husband of the informant as a result of which, he died during course of treatment.

4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Allegation of assault is general and omnibus and there is no specific accusation of overt act against this petitioner.

5. Learned counsel for the informant vehemently opposed the bail application and submitted that there is specific accusation against the petitioner that he along with other accused persons assaulted the husband of informant, as a result of which he died.

6. Considering the nature of accusation and gravity of the offence, prayer for anticipatory bail of the petitioner is refused.
