JUSTICE MOHIT KUMAR SHAH ORAL ORDER 20-03-2024 The present writ petition has been filed seeking the following relief:- "(1)(i) For issuance of an appropriate writ(s)/ Rule(s)/Direction(s) in the nature of mandamus commanding the concerned respondents, for granting benefits of second ACP and third ACP (MACP) to the petitioner from due date and all the consequential benefits thereof, terms of M.A.C.P. Rules, 2010. in (ii) For issuance of an appropriate writ(s)/ rule(s)/direction(s) to the concerned

Patna High Court CWJC No.15931 of 2022(2) dt.20-03-2024 2/3 respondents for fixation of petitioner's payscale after granting the benefits of ACP and MACP from due date and for payment of differential amount of salary as well as all retirement benefits with statutory interest, to the petitioner.

(iii) For issuance of an appropriate writ(s) / Rule(s)/Direction(s) to the concerned respondents for fixation of last pay- scale of the petitioner, on the basis of MACP and for payment of differential amount of pension thereof with effect from 01.06.2021 as the petitioner was superannuated from service on 31.05.2021.

(iv) For issuance of an appropriate writ(s) / rule(s)/direction(s) to the concerned respondents for payment of salary to the petitioner for the period of 01.04.1982 to 11.05.1982, 01.05.1997 to 31.07.1997, 01.05.1998 to and 01.03.2002 to 31.03.2002."

At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the respondent no.2 i.e. the Commissioner, Departmental of Registration, Excise and Prohibition, Government of Bihar, Patna for redressal of his aforesaid grievances. Liberty,

Patna High Court CWJC No.15931 of 2022(2) dt.20-03-2024 3/3 so sought, is granted.

It is needless to state that in case appropriate representation is filed, within a period of two weeks from today, the respondent no.2 shall dispose off the same by passing a reasoned and a speaking order, in accordance with law, within a period of six weeks, thereafter.

The writ petition stands disposed off on the aforesaid terms.
