2. The petitioner is apprehending arrest in a case registered for the offences punishable in connection with Bathana P.S. Case No.96 of 2023 under Sections 399, 402 and 414 of the Indian Penal Code read with Sections 25(1-b)A/ 26/35 of the Arms Act.

3. As per the prosecution, the FIR has been lodged against 5 named accused persons including the petitioner against whom there is allegation that they are involved in loot and selling of different mobiles which are subject to theft.

4. Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He submits that on early occasion, case diary has been called for.

5. From the pleadings, it transpires that paragraph 3 of the memo, the petitioner has disclosed that he has clean antecedent whereas paragraph 23 of the case diary indicates that his antecedent is not clean and he is absconding in the said case which is relating to robbery.

6. Learned APP for the State opposes the prayer for bail and submits that in different paragraphs of the case diary, it has come that the petitioner is involved in selling of mobiles and accused persons has provided 17 mobiles to him.

7. In the present facts and circumstances, this Court is not inclined to grant anticipatory bail to the petitioner, therefore the bail application of the petitioner is hereby rejected. (Dr. Anshuman, J.) Prakashmani/- U T
