This is a petition for grant of anticipatory bail for offence under Sections 365, 386, 413, 414, 379 and 120(B)/34 of the Penal Code.

The learned counsel for the petitioner submits that the victim who was kidnapped by one Pawan Sah, who disclosed that Ramyash Sah is his father-in-law whose money was lost in the garage of the informant and he was pressed to pay rupees ten lakhs instead of rupees five lakhs. The learned counsel for the petitioner submits that in the case diary it has come that Ramyash Sah has no relation with Pawan Sah.

The learned counsel for the State, however, submits that there is statement of spy in paragraph 27 of the case diary and except that there is no material against the petitioner.

Patna High Court Cr.Misc. No.36571 of 2014 (3) dt.20-04-2015 Hence, having regard to the facts and circumstances of the case, the petitioner, above named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, is directed to be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with the Jhanjharpur P.S. Case No. 146 of 2013 G.R. No. 1447 of 2013 to the satisfaction of the Additional Chief Judicial Magistrate, Jhanjharpur, Madhubani, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.

If the charge sheet is submitted against the petitioner, then, he will appear and receive the police paper and shall appear in the case on the date fixed and any absence shall be subjected to satisfaction of the trial Court.
