The petitioner apprehends his arrest in connection with Birpur (Bhimnagar O.P.) P.S. Case No. 142 of 2016 registered under Sections 419, 420, 120B of the Indian Penal Code and U/s 27(b)(ii), 28A, 27(d) of the Drugs and Cosmetics Act and Section 47(g) of the Bihar Excise (Amendment) Act. The accusation is that on raid of the clinic of the petitioner by the Drug Inspector, two cartoons Corex Syrup each bottle containing 100 ml. were recovered. The local people used to Corex Syrup as intoxicant.
Learned counsel appearing on behalf of the petitioner submits that petitioner has falsely been implicated in
Patna High Court Cr.Misc. No.34048 of 2016 (2) dt.26-08-2016 2/2 this case. It is further submitted that petitioner is registered Rural Medical Practitioners.
Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M., Birpur (Supaul) in connection with Birpur (Bhimnagar O.P.) P.S. Case No. 142 of 2016, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Rajendra Kumar Mishra, J) Shail/- U T
