2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 341 , 323 , 324, 307 and 504/34 of the Indian Penal Code.

3. It is alleged that on account of land dispute these petitioners along with other co-accused persons assaulted the son and daughter-in-law of the informant by means of iron rod.

4. It is submitted on behalf of the petitioners that the informant is own grandmother of these petitioners and due to land dispute between them they have been made accused in this case. Allegation of assault is general and omnibus. No specific

Patna High Court CR. MISC. No.62634 of 2023(2) dt.11-10-2023 2/2 overt act is alleged against these petitioners. After investigation police submitted final form in the case. Differing with the same, Court below has taken cognizance . Petitioners claim clean antecedent.

5. Learned counsel for the State oppose the bail petition.

6 Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate , Jamui in connection with Khaira P.S. Case No. 398 of 2021 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
