ANJANA PRAKASH ORAL ORDER 11-02-2015 In the nature of dispute between the parties, notices had been issued to the Opposite Party No.2 but she has refused the notice.
Considering the merits of the case, the provisional anticipatory bail granted to the Petitioner by order dated 11.1.2013 is hereby confirmed in connection with Complaint case No.415C of 2011 pending in the court of Sub Divisional Judicial Magistrate, West Champaran at Bettiah on condition that the petitioner will be well represented on each date if he fails to do so on two consecutive dates, his bail will be liable to be cancelled. The petitioner is directed to deposit Rs.750/- (seven hundred and fifty) per month in the Court below firstly within
Patna High Court Cr.Misc. No.434 of 2013 (4) dt.11-02-2015 2/2 15 days from the date of receipt of this order and subsequently by 15th every month which the wife of the petitioner will be at liberty to withdraw without prejudice the right of the parties. The court below shall inform the wife of the petitioner about the present order. However, if the Complainant/informant has a Bank account or subsequently opens a Bank account, the money shall be deposited in the account and a receipt to this effect shall be filed by 15th every month in the court below and in case he fails to do so his anticipatory bail would be automatically cancelled.
