JUSTICE ARUN KUMAR ORAL ORDER 11-01-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section 30(a) of the Bihar Excise Act, 2016.

Allegation in brief against the petitioner is that he was driving a motorcycle and from possession of pillion rider, approximately six litres country made English liquor kept in a bag were recovered.

Learned counsel appearing on behalf of the petitioner submits that the petitioner had no knowledge what material was being carried by the pillion rider. He has got no criminal antecedent and is languishing in jail custody since 18.12.2016. Considering the aforesaid facts and circumstances

Patna High Court Cr.Misc. No.550 of 2017 (2) dt.11-01-2017 2/2 and in particular that the bag was recovered from the pillion rider and petitioner has got no criminal antecedent, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M. IVth, Banka in connection with Dhoraiya P.S. Case No.274 of 2016.
