Mr. Gauri Shankar Gupta ====================================================== CORAM: HONOURABLE MR. JUSTICE SANDEEP KUMAR ORAL ORDER 26-09-2025 Heard the learned counsel for the petitioner and the learned APP for the State.

2. This is the 2nd attempt of the petitioner for regular bail in connection with Town P.S. Case No. 04 of 2025 registered for the offence under Sections 103(1) and 61(2) of the Bharatiya Nyaya Sanhita, 2023 and Section 27 of the Arms Act. Earlier the bail application of the petitioner was dismissed as withdrawn on 30.04.2025 in Cr. Misc. No. 24035 of 2025.

3. As per the prosecution case, the petitioner and others are accused of committing the murder of the deceased.

4. Learned counsel for the petitioner submits that petitioner is in custody since 05.01.2025. He further submits the co-accused Ajeet Kumar has been granted regular bail by a coordinate Bench of this Court in Cr. Misc. No. 44353 of 2025 dated 18.07.2025. It has come during the investigation that one

Patna High Court CR. MISC. No.59095 of 2025(2) dt.26-09-2025 2/2 Dharmendra Kumar had killed the deceased. He also submits that the petitioner and others had brought the deceased in the hospital for treatment and the petitioner has been arrested from the hospital.

5. Learned A.P.P. for the State has vehemently opposed the prayer for bail.

6. Considering the aforesaid facts and circumstances, this application for regular bail is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra/concerned Court below in connection with Town P.S. Case No. 04 of 2025 subject to condition that:- (i). The Petitioner will cooperate in the framing of charge and he will personally appear on each and every date till the framing of the charge. After the framing of the charge, he can appear personally or through his lawyer on the date fixed by the Court below.
