JUSTICE MOHIT KUMAR SHAH ORAL ORDER 18-08-2023 The present writ petition has been filed seeking the following relief(s):- "1. That this application is directed for issuance of a writ in the nature of certiorari for quashing the order dated 25.8.14 issued vide Memo no. 469 dated 25.8.14 Under Seal & Signature of respondent no. 3 Whereby the claim of promotion of the petitioner on the post of Assistant Engineer (Mechanical) had been denied with effect from 1982.
Further a writ of Mandamus be issued commanding the respondents to implement the decision of the government vide Memo no. 260
Patna High Court CWJC No.9842 of 2015(2) dt.18-08-2023 2/2 dated 22.1.82 and grant promotion to the petitioner with retrospective effect with all consequential benefit."
At the outset, the learned counsel for the petitioner submits that according to his instructions, the criminal case in question has already been closed, hence he be granted liberty to approach the respondent-authorities, informing them about the same so that they can take a fresh decision with regard to the matter of promotion of the petitioner. Liberty so sought is granted.
