ANJANA MISHRA ORAL ORDER 05-09-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 19.07.2019 in connection with Daraunda P.S. Case No.153 of 2019 registered for the offence under Sections 30(a) and 32(ii) of the Bihar Prohibition and Excise, 2018.

Learned counsel for the petitioner submits that the alleged recoveries were not from the conscious possession of the petitioner but from the house which was in joint possession. The petitioner is not having any criminal antecedent.

Considering the aforementioned facts and circumstances and that the petitioner has no criminal antecedents, let the petitioner, above named, be released on

Patna High Court CR. MISC. No.56303 of 2019(2) dt.05-09-2019 2/2 bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge Cum Special Judge, Excise, Siwan, in connection with Daraunda P.S. Case No.153 of 2019.
