The petitioner seeks bail in connection with Patepur P.S. Case No. 15 of 2016 registered for the offences punishable under sections 420 and 379 of the Indian Penal Code. It is contended that apart from the confessional statement of co-accused Santosh Kumar, there is no other material to connect the petitioner with the alleged occurrence. The petitioner is neither named in the first information report nor he has been put on T.I. parade. There is no recovery of any incriminating article from the possession of the petitioner, who is in custody since 28.03.2016.

Learned counsel for the State has opposed the application for grant of bail to the petitioner.

No.35224 of 2016 (2) dt.20-08-2016 Be that as it may, regard being had to the nature of the offence, time spent in custody as also the fact that the petitioner is reported to be a man of clean antecedent, he is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate X, Vaishali at Hajipur in connection with Patepur P.S. Case no. 15 of 2016.
