JUSTICE SANJEEV PRAKASH SHARMA ORAL ORDER 20-03-2023 The petitioner by way of this writ petition assails the order of cancellation of license for PDS shop dated 30th December 2011 and the order passed in appeal whereby appeal dated 18.08.2015 whereby his appeal was rejected on the grounds of gross latches and delay.
Learned counsel for the petitioner submits that he should be given one other opportunity to explain the delay. I have considered the situation, the license was cancelled in 2011, more than 10 years have passed by and the appeal was also preferred after a almost three and a half years
Patna High Court CWJC No.13301 of 2016(3) dt.20-03-2023 2/2 which was in the opinion of this Court was rejected on the grounds of gross latches, as correct.
Taking note of the license having being cancelled way back in 2011 and the new provisions have been introduced by order of 2016. The writ petition is dismissed as becoming otiose.
