This application for anticipatory bail arises out of Bakhari P.S. Case No. 185 of 2018 for the offence punishable under Sections 328, 302, 406 and 120(B)/34 of the Indian Penal Code.
The petitioner is mother of co-accused Binod Kumar Sah.
Learned counsel appearing on behalf of the petitioner, referring to the First Information Report, has submitted that the allegation, if any, is against co-accused Binod Kumar Sah and the petitioner has been implicated only because she is mother of said Binod Kumar Sah. He has further submitted that Binod Kumar Sah has been allowed regular bail by this Court by order dated 31.01.2019 passed in Cr. Misc. No. 72325 of 2018.

Let the petitioner above named, in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-V-cum-Sub Judge-III, Begusarai, in Bakhari P.S. Case No. 185 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
