2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 26, 33 , 41 and 42 of the Forest Act 1927 .

3 . As per the prosecution case , informant alleged that on 16.03.2018 , he received a secret information that in Sharda Mica Mines Charkari, some persons died due to illegal excavation and upon such information , informant along with others went on the spot for inspection wherein he found that soil

Patna High Court CR. MISC. No.60422 of 2025(2) dt.08-09-2025 2/3 was slipped and three men died being crushed under soil and forest mafia concealed dead body and fled away . It is further alleged that on 28.03.2018 , the prosecution party went on the spot and found holes on several places and also found thin wires of gunpowder. The name of accused persons disclosed by local villagers. Accordingly, the present case was lodged.

4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence as alleged. Petitioner has been made accused in this case only on the disclosure of local villagers. Petitioner has got no concern with the alleged occurrence . During course of investigation , there is no direct or indirect material has come against this petitioner to show his complicity in the alleged occurrence .

5. Learned counsel for the State opposes the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within eight weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM Nawada in connection with G. O ( F ) P.S. case No. 69 of 2019 , subject to the conditions
