The petitioners being the parents of the husband of the informant are apprehending their arrest in a case registered for the offences punishable under section 498 (A)/34 of the Indian Penal Code and 3⁄4 of the Dowry Prohibition Act. The basic accusation is of torture for non fulfillment of dowry demand.
It is submitted by the learned counsel for the petitioner that the informant entered into compromise with her husband on the basis of which husband of the complainant has been granted bail.
Patna High Court Cr.Misc. No.38054 of 2014 (2) dt.10-02-2015 2/2 Considering the fact that the accusation is of general and omnibus nature and the husband of the informant is on bail, let the petitioners above named be released on bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today in connection with Asarganj P.S.Case No. 56/2013 on furnishing bail bond of Rs. 10,000/-( Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Munger, subject to the conditions as laid down under section 438 (2) of the code of Criminal Procedure .
