The petitioner seeks bail in a case registered for the offences punishable under Section 392 of the Indian Penal Code and after investigation charge-sheet came to be submitted under Sections 395 and 412 of the I.P.C.

Learned counsel for the petitioner submits that the petitioner is in custody since 02.08.2021, charge-sheet has been submitted in the case, he has antecedent of two cases and the informant alleges that three unknown criminals looted his car and fled towards Bikramganj.

Learned counsel for the petitioner submits that the F.I.R. was against unknown and the name of the petitioner

Patna High Court CR. MISC. No.70439 of 2021(2) dt.05-05-2022 2/2 transpired in the confessional statement of co-accused. It is further submitted that the petitioner was never put on T.I.P. nor any incriminating article was recovered from his possession to connect him with the offence.

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 02.08.2021, charge-sheet has been submitted in the case, he was not put on T.I.P., nor any recovery was made from his possession, let the petitioner above named be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Dawath P.S. Case No. 103 of 2020 with a condition that one of the bailors of the petitioner shall be his father, Ram Deo Singh. (Satyavrat Verma, J) Rishi/- U T
