The Petitioner seeks bail in Rajgir P.S. Case No.220 of 2016 instituted for the offence under Section(s) 406, 420, 379, 506 Indian Penal Code.
It is alleged that the petitioner being Munshi had committed theft of record of a proceeding under Section 145 Cr. P.C. bearing Case No.166 of 2011 from the Court of the SDO, Rajgir. Subsequently, the petitioner after taking rupees twenty five thousand handed over the record to the Informant, who is the Bench Clerk of the concerned Court. The petitioner is in custody since 18.11.2016.
It is admitted position from the written report itself
Patna High Court Cr.Misc. No.2218 of 2017 (2) dt.03-02-2017 2/2 that the record has already been traced and handed over to the Informant.
In view of such, let the Petitioner, above named, be released on bail on furnishing bail bond of `10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate- IV, Nalanda at Biharsharif, in connection with Rajgir P.S. Case No.220 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) JA/- U T
