JUSTICE SATYAVRAT VERMA ORAL ORDER 06-01-2022 The present case has been taken out of turn on account of urgency mentioned by the learned counsel for the petitioner stating that the mother of the petitioner is suffering from brain tumor and in support of that the petitioner has annexed the prescription issued by National Institute of Mental Health and Neuro Sciences, Bangalore.

Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual court proceedings. The petitioner seeks regular bail in connection with Patrakar Nagar P.S. Case No. 407 of 2021 instituted for the offences under Sections 392 and 402 of the Indian Penal Code read with Sections 25(1-B)a and 26 of the Arms Act. Learned counsel for the petitioner submits that allegation is of recovery of a country-made pistol and a live cartridge.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, nothing was recovered from his possession.

Shri Bharat Lal, learned A.P.P. for the State vehemently opposes the prayer for bail of the petitioner. Considering the fact that the petitioner is in custody since 30.07.2021 and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand only) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-VIII, Patna in connection with Patrakar Nagar P.S.
