JUSTICE BIRENDRA KUMAR ORAL ORDER 21-02-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. This is a petition for grant of regular bail for the offences under Sections 364, 120B, 34 of the Indian Penal Code. The allegation is that co-accused Pankaj Singh and others allegedly kidnapped Vinay Kumar for the reason that Vinay Kumar has love affairs with the daughter of Pankaj Singh. The victim boy Vinay Kumar in his statement under Section 164 Cr.P.C has supported the allegation of kidnapping and assault by Pankaj Singh and others including the petitioner. It is submitted by learned counsel for the petitioner that co-accused Pankaj Singh has already been allowed bail by learned Court below and the allegation against the petitioner is of similar footing.

No.8315 of 2017 (2) dt.21-02-2017 2/2 Considering the fact that similarly situated coaccused Pankaj Singh has been granted bail by learned Court below, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Begusarai /Successor Court in connection with Matihani P.S. Case No. 14 of 2016. The bail bonds of the petitioner shall be accepted by learned Court below on verification of the fact whether co-accused Pankaj Singh has been allowed bail by learned Court below or not and only thereafter the bail bonds of the petitioner shall be accepted.
