The admitted position is that the trial in Special Case no. 41 of 2014, arising out of Kishanganj Police Station Case No. 154 of 2014 dated 23.3.2014, has progressed in the court below and in view of the averments made in the counter affidavit that materials have been collected in course of the investigation, it would not be appropriate for this Court to look into the correctness or otherwise of the allegations, while exercising jurisdiction under section 482 Cr. P. C. Petitioner submits that at the time of occurrence he was not in government service and that there is no details with respect to the persons who have been cheated or defrauded. It is observed that the contention of the petitioner would be looked into/examined by the trial court at the
Patna High Court Cr.Misc. No.36796 of 2014 (9) dt.11-10-2017 2/2 appropriate stage, in accordance with law, without being prejudiced by this order.
