JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 12-06-2020 Heard learned counsel for the petitioner and the State. The petitioner is apprehending arrest in connection with Bhagwanganj P.S. Case No. 50 of 2019 for the offence under Sections 323, 341, 307, 504/34 of the Indian Penal Code and Section 27 of the Arms Act.
Learned counsel for the petitioner submits that there is no specific overt act is alleged against the petitioner and the allegation of firing is against Santosh Kumar. He further submits that the petitioner has been implicated in this case due to enmity. He further submits that the petitioner has no criminal antecedent.
Considering the aforesaid, the petitioner named above, in the event of arrest or surrender before the court below within one month from today, is directed to be released on bail
Patna High Court CR. MISC. No.57973 of 2019(7) dt.12-06-2020 2/2 on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of B. N. Tripathi, Judicial Magistrate, 1st Class, Masaurhi, Patna in connection with Bhagwanganj P.S. Case No. 50 of 2019 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure with the condition that the petitioner will render his service as volunteer for a period of one month in dedicated Covid Hospital.
