This is a petition for grant of regular bail for offences under Sections 420, 406, 504, 506, 384 and 120B of the Indian Penal Code.

Some unknown persons committed theft of Bolero four wheeler jeep of the informant. The investigation of the case was going on. In the meantime, some one phoned to the informant from the referred mobile that if the informant manages money, the vehicle would be returned. The money was paid through the petitioner and others, however, vehicle was not recovered. Submission of the petitioner is that with same allegation co-accused, Gautam Kumar, has already been allowed bail by the learned Court below.

The same Sessions Judge, Aurangabad, has passed both the orders. The case was not distinguishable on merit rather only considering period already undergone by co-accused, Gautam Kumar, bail was granted. Considering the facts and circumstances, let the

No.8281 of 2017 (3) dt.28-03-2017 2/2 petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Aurangabad (Town) P.S. Case No. 379 of 2016 to the satisfaction of the Chief Judicial Magistrate, Aurangabad, or successor Court with the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the Court below shall be at liberty to cancel the bail bond of the petitioner.
