JUSTICE SANJAY PRIYA ORAL ORDER 18-03-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The Petitioner seeks bail in K. Nagar P.S. Case No. 281 of 2016 instituted for the offence under Section(s) 412 of the Indian Penal Code and Section 25(1-B) a, 26, 35 of the Arms Act.

It is alleged that one country made pistol, two cartridges and one SIM alleged to be robbed in K. Hat P.S. Case No. 356 of 2016 have been recovered from the possession of this petitioner.

It has been submitted that petitioner has been granted bail in K. Hat P.S. Case No. 356 of 2016 by learned 1st Additional Sessions Judge, Purnea in B.P. No. 1227 of 2016 and

Patna High Court Cr.Misc. No.8858 of 2017 (2) dt.18-03-2017 2/2 B.P. No. 1029 of 2016 on 02.01.2017.

From the impugned order, it appears that petitioner is in custody in this case since 21.08.2016. Keeping in view the period spent in custody by the petitioner, prayer of the petitioner for grant of bail is allowed. Let the Petitioner, above named, be released on bail on furnishing bail bond of 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnia in connection with K. Nagar P.S. Case No. 281 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner.
