JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-09-2019 Earlier prayer for bail of the petitioner was rejected twice by this Court firstly by order dated 27.7.2017 passed in Cr. Misc.No. 34501 of 2017 and secondly by order dated 31.1.2019 passed in Cr.Misc.No. 3050 of 2019. Petitioner happens to be husband and allegation is of committing dowry death.
Submission of learned counsel for the petitioner is that he is in custody for about three years and four witnesses have been examined as yet and the case is pending for examination of two other witnesses.
Heard learned APP, who has opposed the prayer for bail stating that deceased died only after 46 days of her marriage.
In the facts and circumstances, I am not inclined to
Patna High Court CR. MISC. No.55994 of 2019(2) dt.04-09-2019 2/2 grant bail to the petitioner.
However, since the petitioner is in custody for about three years, learned trial court is directed to conclude the trial as early as possible and at the same time S.S.P., Patna is directed to ensure the presence of remaining witnesses, including the I.O. in court, so that the trial may be concluded at the earliest. With the above observation, this application is dismissed.
