JUSTICE PRABHAT KUMAR JHA ORAL ORDER 07-12-2016 Heard Ms. Soni Srivastava, learned counsel for the petitioner and learned counsel for the State. The petitioner has filed this petition for modification of the order dated 22.07.2016, passed in Cr. Misc. No. 10374 of 2015, praying therein that the petitioner was not heard and the petitioner was willing to make payment of half of the amount for which cheque was issued, but it appears that prayer for anticipatory bail of the petitioner was rejected firstly on 05.02.2014 passed in Cr. Misc. No. 23549 of 2013. Thereafter, the petitioner moved before the Supreme Court in Special Leave to Appeal 6459 of 2014 and the same was permitted to be withdrawn. Again, the petitioner filed Cr. Misc. No. 10374 of

Patna High Court Cr.Misc. No.34103 of 2016 (2) dt.07-12-2016 2/2 2015 which was dismissed on 22.07.2016.

Considering the facts aforesaid, I do not feel inclined to make any modification in the order dated 22.07.2016 passed in Cr. Misc. No. 10374 of 2015. Accordingly, the modification petition is dismissed.
