The petitioner is apprehending his arrest in connection with Barachatti (Mohanpur) P.S.Case No. 194 of 2016 registered for the offences punishable under Sections 341, 323, 307, 504, 506 and 34 of the Indian Penal Code including Sections 3 and 4 of Witch Craft Act.

It has been submitted on behalf of the petitioner that allegation against the petitioner is that he assaulted the informant with lathi calling her Dyne. It has further been submitted that many people have assaulted the informant but the injury report does not support the manner of the case.

Heard learned APP and informant also, who have opposed the prayer for bail stating the injury sustained by the

Patna High Court Cr.Misc. No.4303 of 2017 (2) dt.10-02-2017 2/2 informant is grievous in nature, which is evident from the impugned order itself.

Having heard both sides and considering the nature of allegation and the injury sustained by the informant, I am not inclined to grant anticipatory bail to the petitioner. However, he may surrender and pray for regular bail in the court below, which shall be considered and disposed of on its own merit, without being prejudiced by this order.
