This is an application for bail in connection with Konch P.S.Case No. 35 of 2016 registered for the offences punishable under Sections 302/34 of the Indian Penal Code and 27 of the Arms Act.
It has been submitted on behalf of the petitioner that only one injury has been found on the abdomen of the deceased caused by one Mahesh Sharma and the allegation against the petitioner is of firing also but his shot is not the cause of death. Heard learned APP also, who has opposed the prayer for bail.
Having heard both sides and in view of the fact that there is direct allegation against the petitioner of firing on the
Patna High Court Cr.Misc. No.8947 of 2017 (2) dt.27-02-2017 2/2 deceased and thereafter Mahesh Sharma has also shot at the deceased, I am not inclined to grant bail to the petitioner. However, learned court below is directed to expedite and conclude the trial within a period of one year. If the trial is not concluded within the said period, the petitioner may renew his prayer for bail.
With the aforesaid observations, this application is dismissed.
