JUSTICE ARVIND SRIVASTAVA ORAL ORDER 13-09-2017 Heard learned counsels for the petitioner and the State. Petitioner apprehends arrest in connection with Bhabua P.S. Case No. 28 OF 2015 registered for the offence punishable under sections 323, 504, 419, 420, 467, 468, 471, 120b of the Indian Penal Code.
Learned counsel appearing for the petitioner submits that after the death of the husband of the petitioner, petitioner started living at Varanasi due to threat of her life. Petitioner sold her share in property to the informant, who purchased the land after knowing about the family status of the petitioner. Only after filing of the case by her sister-in-law, the present case has been lodged by the informant to create defence. It is further stated that parties have compromised the matter and are not willing to

A joint compromise petition has also been filed before the Court below, copy of which is annexed as Annexure-5 to the supplementary affidavit filed today. Considering the facts and circumstances of the case and the submissions of advanced on behalf of the parties, let the petitioner, above named, in the event of her arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kaimur at Bhabua in connection with Bhabua P.S. Case No. 28 of 2015.
