JUSTICE MOHIT KUMAR SHAH ORAL ORDER 18-08-2023 The present writ petition has been filed seeking the following relief:- "1. That this is an application for issuance of an appropriate writ order or direction commanding the Respondents to appoint the petitioners on the post of constable in District Police Force/B.M.P. as the petitioners had applied against Advt. No.1/2014 issued for appointment on the post of constables by respondents and were successful in all the tests however even though they as per their merit deserved to be appointed in their categories in the final result which has been published on 23 June 2015 their Roll numbers have not been mentioned in successful list of candidates and

Patna High Court CWJC No.10078 of 2015(2) dt.18-08-2023 2/2 neither their marks nor marks of successful candidates have been shown nor the reason why they have not been declared finally successful has been disclosed which is highly illegal arbitrary, malafide discriminatory or for any other order or orders which this Hon'ble Court may deem fit and proper under the circumstances of this case." 2.

At the outset, the learned counsel appearing for the Central Selection Board of Constable, Bihar, Patna, submits that as far as the petitioner no. 1 is concerned, she has failed to secure the minimum qualifying marks in the final exam and as far as the petitioner no. 2 is concerned, he was caught committing fraud, hence, an FIR has been lodged against him thus, they have not been selected, hence there is no merit in the present writ petition.

In view of the aforesaid, the learned counsel for the petitioners submits that the present writ petition be disposed off. 4.
