This is an application for bail in connection with Gangta P.S.Case No. 49 of 2016, corresponding to G.R.No. 1897 of 2016, registered for the offences under Section 30(a) of Bihar Excise Prohibition Act, 2016.

It has been submitted on behalf of the petitioner that petitioner has clean antecedent and has remained in custody for four months. No doubt, huge quantity of wine has been recovered from the vehicle of the petitioner but that is not his property and he traveler of the car and has no concern with the wine. Heard learned APP also.

Having heard both sides and considering the fact that huge quantity of wine has been recovered from the petitioner, I am

Patna High Court Cr.Misc. No.6445 of 2017 (3) dt.16-02-2017 2/2 not inclined to grant bail to the petitioner. However, petitioner may renew his prayer for bail after completion of custody for six months before the court below and learned court below will consider the prayer for bail keeping in view the period of custody as well as considering the fact that other co-accused have been granted bail by this Court and dispose it of without being prejudiced by this order. With the above observations, this application is disposed of.
